My Storybook is a trading name and service operated by Group Hugs Inc Limited. My Storybook is not a separate legal entity.

Group Hugs Inc Limited is a company registered in England and Wales under company number 14476547, with its registered office at Dejan Business Park, Second Avenue, Kent ME4 5AU. Our VAT registration number is 429 0060 21.

In these Terms, references to "My Storybook", "we", "us" or "our" mean Group Hugs Inc Limited trading as My Storybook, unless the context requires otherwise.

These Terms apply to your use of www.my-storybook.co.uk (the "Site") and to purchases of products and services made through the Site.

By placing an order through My Storybook, you agree that you are entering into a contract with Group Hugs Inc Limited on these Terms.

Our Privacy Policy also explains how we collect, use and protect personal information.

1. About My Storybook

My Storybook provides customers with the ability to order personalised printed products created using content, information, photographs, images and other material supplied or approved by the customer.

Products available through My Storybook may change from time to time. We may introduce new products, change existing products or discontinue products.

Our products are intended primarily for personal and domestic use unless we expressly agree otherwise.

2. Information You Provide

When placing an order, you must provide accurate, complete and current information.

You are responsible for ensuring that the email address, telephone number, delivery address and other information supplied with your order are correct.

We may use the contact details you provide to send important information concerning your order, including order confirmations, requests for information and dispatch notifications.

If you discover an error in the information supplied with your order, please contact us as soon as possible at [email protected].

We cannot guarantee that changes can be made after an order has entered production.

3. Payment

When creating an account or placing an order, you will be required to provide an accepted payment method.

By submitting an order, you confirm that you are authorised to use the payment method provided.

Payment will normally be taken when your order is placed.

If payment cannot be authorised, your order may not be accepted.

We reserve the right to cancel or suspend an order if we reasonably believe that a payment method has been used fraudulently, without authorisation or otherwise unlawfully.

4. Personalised Products and Customer Content

Products supplied through My Storybook may be created using text, photographs, illustrations, names, dates, information or other material supplied or approved by you ("Customer Content").

You are responsible for checking the information and Customer Content supplied for your order before confirming your purchase.

You confirm that you have all permissions, licences and rights necessary for us to use the Customer Content for the purpose of fulfilling your order.

You must not provide Customer Content that infringes another person's copyright, trade mark, privacy or other legal rights, or which would be unlawful for us to reproduce.

We do not claim ownership of your Customer Content.

By submitting Customer Content to us for an order, you grant Group Hugs Inc Limited a non-exclusive, royalty-free licence to use, reproduce, adapt, process and print that Customer Content to the extent reasonably necessary to create, manufacture, fulfil and deliver your order and provide the associated services.

This licence does not give us the right to commercially exploit your Customer Content for unrelated purposes without your permission.

Where reasonably necessary to manufacture a Product, we may make technical adjustments to Customer Content, including resizing, cropping, compression, colour adjustment, brightness adjustment or other processing required for printing.

Differences may occur between the appearance of colours and images on a screen and their appearance when printed. Such differences do not necessarily mean that a Product is faulty.

We are not responsible for spelling mistakes, factual inaccuracies, image quality issues or other errors contained in Customer Content supplied or approved by you, except where an error has been introduced by us.

5. Orders and Formation of the Contract

To place an order, you will select your Product and complete the checkout process on the Site.

Before submitting your order, you will have an opportunity to review the information relating to your purchase.

By clicking the relevant order or payment confirmation button, you are offering to purchase the selected Product from Group Hugs Inc Limited trading as My Storybook.

After receiving your order, we will send you an order confirmation by email.

We reserve the right not to accept an order. Reasons may include:

  • the Product being unavailable;
  • our inability to authorise or process your payment;
  • an obvious pricing or Product-description error;
  • technical problems with Customer Content or files required to produce the Product;
  • the order or Customer Content breaching these Terms; or
  • circumstances in which fulfilling the order would be unlawful.

If we cannot accept an order after payment has been taken, we will notify you and refund the relevant payment.

6. Personalised Products and Cancellation

Products created specifically for you using your selected or supplied personalisation are personalised or bespoke goods ("Personalised Products").

Under UK consumer law, the usual statutory right to cancel or amend an online purchase during the cooling-off period does not apply to goods purchased at www.my-storybook.co.uk

Where possible, we will try to assist with changes to delivery details if you contact us promptly. However, we cannot guarantee that any requested change can be made once an order has been processed or dispatched.

This clause does not affect your statutory rights where a Product is faulty, damaged, not as described or otherwise does not conform to the contract.

7. Production and Delivery

We will provide an estimated production and/or delivery timeframe during the ordering process or in communications concerning your order.

Unless we tell you otherwise, we aim to deliver accepted orders within 21 days (3 weeks) of the order being placed.

We may use different postal or courier services to fulfil orders. Your dispatch notification may identify the carrier used.

We are not responsible for delays caused by circumstances outside our reasonable control, although this does not affect any statutory rights you may have.

If an order has not arrived by its estimated delivery date, please contact us. Depending on the delivery service and destination, we may need to allow a reasonable period for the carrier to investigate.

For UK deliveries this may normally require an additional 4–6 days.

If delivery cannot be completed because nobody is available to receive the Product, the carrier may provide instructions for redelivery or collection.

If a Product is returned to us because you have not collected it, arranged redelivery, provided a correct address or otherwise taken reasonable steps to enable delivery, we may charge the reasonable direct costs of arranging another delivery.

8. Faulty, Damaged or Incorrect Products

Your statutory rights are not affected by these Terms.

Products supplied by us must comply with the requirements imposed by applicable UK consumer law, including requirements relating to satisfactory quality, fitness for purpose and correspondence with their description.

If you believe that your Product is faulty, damaged, incorrectly manufactured or does not match your order, please contact us at [email protected] as soon as reasonably possible.

We may ask you to provide photographs or other reasonable information so that we can investigate the problem.

Depending on the circumstances and your statutory rights, an appropriate remedy may include repair, replacement, price reduction or refund.

Nothing in these Terms is intended to exclude, restrict or replace rights or remedies that cannot lawfully be excluded under UK consumer law.

9. Storage of Customer Content

Where Customer Content is uploaded, transferred or otherwise provided to us for production, we will temporarily store that content for the purpose of processing and fulfilling your order.

Unless we expressly tell you otherwise, My Storybook is not a permanent file-storage or backup service.

If an order has not been made within 45 days of uploading information it will be removed from our system unless a monthly fee is paid to cover the storage or an order is placed.

You are responsible for retaining your own copies of photographs, text, files and other Customer Content.

Where our current service provides for Customer Content to be retained for up to 90 days following an order, it will be permanently deleted after that period.

You should therefore never rely on My Storybook as the sole storage location for important photographs, files or other content.

We may change our operational storage periods from time to time, subject to applicable data protection requirements and any commitments we have expressly made to you.

10. Intellectual Property

All intellectual property rights in the My Storybook website, branding, software, designs and other materials provided by us are owned by or licensed to Group Hugs Inc Limited.

Except as permitted by law or expressly authorised by us, you may not copy, reproduce, distribute, commercially exploit or create derivative works from our Site or materials.

Nothing in these Terms transfers ownership of your Customer Content to us.

You may not use automated systems, robots, scrapers or similar technology to access or extract information from the Site where doing so breaches applicable law or our rights.

11. Privacy and Data Protection

We process personal information in accordance with our Privacy Policy and applicable UK data protection law.

Data Protection Complaints

If you have concerns about how Group Hugs Inc Limited collects, uses, stores or otherwise processes your personal data in connection with My Storybook, you may contact us at:

[email protected]

or write to us at the registered office address set out in Clause 22.

We will investigate data protection concerns appropriately and in accordance with applicable UK data protection legislation.

If you are dissatisfied with our response, you may also have the right to complain to the Information Commissioner's Office (ICO).

12. Our Role

My Storybook provides the service through which personalised Products are created and manufactured.

Where Customer Content has been supplied or approved by you, we are not the creator or publisher of that underlying Customer Content.

We are responsible for producing the Product in accordance with your order and our obligations under applicable law.

13. Acceptable Use

You must not use the Site or our services:

  • for any unlawful or fraudulent purpose;
  • to infringe another person's intellectual property or other rights;
  • to interfere with the operation or security of the Site;
  • to introduce viruses, malicious code or other harmful material;
  • to attempt to obtain unauthorised access to our systems; or
  • in any manner that materially breaches these Terms.

We may refuse, suspend or cancel an order or restrict access to our services where reasonably necessary because of a material breach of these Terms, fraud, unlawful activity, security concerns or a legal or regulatory requirement.

Any cancellation and refund will remain subject to your statutory rights.

14. International Orders and Use

We do not currently allow for orders to be shipped internationally.

15. Availability of the Site

We aim to keep the Site and services available but cannot guarantee continuous or uninterrupted access.

Access may occasionally be restricted because of maintenance, upgrades, technical problems, security issues or circumstances outside our reasonable control.

We may change, update or withdraw features of the Site where we have legitimate legal, operational or commercial reasons for doing so.

16. Our Liability

Nothing in these Terms excludes or limits liability where it would be unlawful for us to do so.

In particular, we do not exclude or limit liability for:

  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation; or
  • breach of your legal rights in relation to Products where those rights cannot lawfully be excluded or limited.

If we fail to comply with these Terms, we are responsible for loss or damage that is a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.

We are not responsible for loss or damage that is not foreseeable.

We are not responsible for defects or errors arising solely from Customer Content supplied or approved by you, provided that we have manufactured the Product in accordance with your order.

Products sold through My Storybook are intended for personal and domestic use. To the extent permitted by law, we will not be responsible for business losses including loss of profit, revenue, business opportunity or business interruption arising from use of a Product for commercial purposes.

17. Your Responsibility

You may be responsible for losses suffered by us where those losses are caused by your unlawful conduct or material breach of these Terms.

Nothing in this clause makes you responsible for losses for which you would not otherwise be liable under applicable law.

18. Assignment

We may transfer our rights and obligations under these Terms to another organisation where permitted by law, provided that doing so does not reduce the rights or protections available to you.

You may only transfer your rights or obligations under these Terms where we agree in writing or where applicable law gives you the right to do so.

19. Entire Agreement

These Terms set out the agreement between you and us relating to your purchase of Products through My Storybook, together with any other terms expressly incorporated into the contract.

Nothing in this clause limits liability for fraud or fraudulent misrepresentation or affects rights that cannot lawfully be excluded.

20. Changes to these Terms

We may update these Terms from time to time.

The Terms that apply to your purchase will normally be the version in force when you place your order, unless a change is required by law or a regulatory authority and is required to apply to an existing contract.

The latest version of these Terms will be published on the Site.

21. General

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

If we do not immediately enforce a provision of these Terms, this does not mean that we have waived our right to enforce it later.

Except where expressly provided otherwise, a person who is not a party to the contract between you and us shall not have any right under the Contracts (Rights of Third Parties) Act 1999 to enforce these Terms.

22. Governing Law and Jurisdiction

These Terms and any contract between you and us are governed by the laws of England and Wales.

If you are a consumer resident in another part of the United Kingdom, you may also have rights to bring proceedings in the courts applicable to the part of the United Kingdom in which you live.

Nothing in these Terms deprives you of any mandatory consumer protection available to you under applicable law.

23. Keeping a Copy of these Terms

You should save or print a copy of these Terms for your records.

The version of the Terms applicable to an order will generally be the version displayed on the Site when that order is placed.
